Does anyone think that if we just smuggled ourselves into France and demanded money from the government and walked in protest on the streets of Paris holding up signs that we are illegal but here to stay that they would just hand money over to us and we would not be arrested?  Or Italy or Spain or ....

I don't understand why anyone is describing this as a tax loophole. This is a description of tax fraud. This is nothing unusual. People declare dependents who don't exist or who don't meet the legal requirements all the time.
I have no problem with the undocumented using ITINs. They pay taxes. They should be able to file tax returns and get their refund. I don't have an issue with rooting out tax fraud. However, there's a lot of tax fraud out there. This is frankly nothing compared to some of the crap that goes on.

I think the translator program you're using isn't working correctly. He didn't say 'shouldn't concern ourselves with', he said there are larger abuses (that frankly cost the taxpayers more money - estimates would put this at less than ~1% of estimated tax fraud costs to the US) out there. It's about prioritizing. e.g. focusing primarily on this would be like a cop chasing down people that get to intersection a bit late and technically run a red light while driving past murders in progress.

I listed my kid on my 1040 and had to include the SSN. Getting a legitimate child tax credit isn't a mistake or a loophole, regardless of the status of the parent. Deliberately claiming credits for children not living with the filer is.

His or her name was kept out of the story for his or her protection.
