Never underestimate a skilled attorney who may subtly lead the USC brass to think Haley may have some dirt to spill - even if he has none.
Part of the payment to Haley will be an investment by USC in not getting further stained. And a good attorney know that's more valuable than plain old age discrimination.

In arbitration, that tactic isn't so useful because there's no public record.

I’m really disturbed by the abundance of last names beginning in “H” — Haley, Heinel, Haden —- in this scandal.

I think a settlement is likely because of the Heinel connection, but nowhere near millions. Mick initially alleged age discrimination. If, after the disclosures about Heinel's activities, he alleges retaliation, for what was he retaliated against? Retaliation implies he knew of the existence of improprieties, and begs the question of what he knew, did, or didn't do. If he knew nothing about it, there's no basis for retaliation. Absent clear evidence of statements concerning his age which might lead to an award of punitive damages, the best Mick could really expect is the equivalent of a few years salary. Reminiscent of the discrimination lawsuit a Notre Dame football AC filed a couple decades ago. He ended up winning somewhere in the neighborhood of $85k. While obviously a "loss" for ND, it had been reported he was demanding millions. Sometimes, if settlement demands are too high, it makes sense to go to trial even if you might "lose." Wow. That's some brilliant jurisprudence. Thanks.

Arbitration should be happening soon. If I understand this LA Times article correctly (from early May) link, the arbitration has been delayed until March of 2020.
