Never been in a mediation, in 30 years, where the mediator actually says "you have no chance - pay her." My guess is that he paid her some small nuisance amount to simply make it go away.

Wasn't picking on Kerri, Donny - my point was only that mediators don't normally look and one side and tell them that they have a dead bang loser of a Case so pay up. I'm sure we would all love to know how they settled it - maybe that will come to light by one of the insiders some day!

I think people would like to know the scope of the complaint. Who wants to take a position without knowledge of the facts. If she breached, thats not fair and if the AVP did, also, but I think beavis is correct that any mediation invovles "some" fact(s) on BOTH sides that need to be entertained.

Some people may have confused or interchanged the terms mediation and arbitration. A mediator is a facilitator that attempts to help the parties arrive at a mutual resolution. An arbitrator acts as a judge would, reviews evidence and makes a binding (usually) finding of fact. beavis is correct in suggesting that a mediator would be unlikely to ever make that type of conclusion or suggestion.

Thanks, guys - looks like I am clearly not the only lawyer around here - HA! I wish Kerri and Donald both nothing but the best, and I truly hope that, now that this Case is settled, maybe they can sit down and iron out their differences (wishful thinking?).

How great would it be if it weren't. Did anyone else see this and imagine Brittany Hochevar in a ski mask? 😂😂 I don’t know about the car incident but they have great surveillance of the house...Definitely a man... She looks like a man |

Sure looks like the mediator said something pretty close since Kerri got paid right after the mediation + she got fees |
