rumor has it the walsh tour may have a similar exclusivity clause in their contracts as well. That would be dumb!! Why not make there schedule not on the same dates and tell the world you can play any tour you want. I think at the end they will be better off and not be like the Avp and nvl and someone have to loose like the nvl did. If Kerri really wants to (grow the game) thats the way she should run it. If she tries to take over like Avp she’s just in it for the money. More importantly, there's no need for her tour to do this. The AVP is already requiring players to sign such an agreement, so anyone playing on the Walsh tour can't play AVP anyway.

Maybe because it's actually a business decision to make the tour more attractive to sponsors and potential tournament organizers. But of course, that would make the anti-AVP whine hypocritical, so I doubt they'll point that out.

If so, everything Kerri has argued about the AVP and the exclusivity limiting the growth of the game would be completely double standard. I wouldn't be able to take anything she said seriously anymore if sold herself out on that.

crawfish: Why would you not be able to sue players if they breach the contract? I mean why would Donald Sun or anyone or you, fund a tour that can't promise the athletes? ESPECIALLY one that is not fundamentally sound, financially....

As I understand the contracts (and I've never actually seen one), players are not signing commitments to play in AVP events, they are signing agreements NOT to play in other events. This is basically a "noncompete" clause which are not enforceable in many states, including California. That said, the AVP can certainly legally prohibit players from playing in AVP events if they violate the contracts. I just don't think they can sue them for playing in the other events.

I have a copy of the contract... it is very enforceable in all states.. and the latest has a clause that states if you are found "Detrimental to the brand" you can be fined up to 5k...

AVP players are invited to do so if they choose to and Donald Sun let’s them....
