If someone were using your phone for illegal practices, wouldn't you be considered as an accessory?

I think this will open up a new defense for online predators who's email was intercepted by the parents, by accident or not. What next, the parents will need a written consent from their kids to get their high school report card?
Hopefully a higher court will overturn this judge's ruling.
