Tax law very much is allowed to consider sham payments that exceed true market value. I'm all for it. Almost all of NIL is sham payments that exceed true market value. Although I'm sure the athlete has to pay income tax on the full amount. How is true market value being determined? The athletes are doing charity work. What’s the true market value of charity work for college athletes?

I'm surprised how little talk there is about what transfers are being offered in NIL to commit to Penn State. Sources close to the program are confirming 20-30K price tag is real.

Or is this more a deal with big time recruits?

I think the problem is the coach is making promises on NIL money, I don't believe that is allowed. But the rules sure aren't clear.

This is what NIL was supposed to be. You sweet summer child. The NCAA knew the whole time exactly what NIL would be. That’s why they fought against it so hard. There’s no realistic way to make it what you seem to want it to be. I don't dispute any of that, I'm just saying that the original idea was for things like this. Katie Ledecky should be able to take money from Speedo and swim for Stanford. Kids should be able to sign posters for money. Everyone knew what it was going to become, but the sponsors of the bills in various state legislatures weren't arguing for what has come of their work.
