It was against the rules at the time. Everyone thinks that suing the NCAA is the solution to everything. Denying NIL opportunities has been found to be unlawful, but no such legal ruling has been made about eligibility, so what legal basis exists to sue? The NCAA adapted its own rules on eligibility, and they could have addressed this issue too. Lobbying the NCAA to voluntarily reverse the vacancies would seem to be a better approach, but even that seems unlikely to succeed. Everyone thinks suing the NCAA is the solution to everything because they always lose. The legal basis is that a bunch of other teams/players have gotten their stuff back (Penn State and Joe Paterno/Lousiville etc). What Hawaii did is legal today and I would argue that the rules simply were not as clear back then with the professional system not being the same as the US system (which the rules were made up for) Anyway, they should ask. The NCAA def has lost some big cases which have created a perception of being a loser, but NIL was an anti-trust issue and it’s Penn St punishment was extraordinarily severe based on a vague institutional control rule. In general, the NCAA’s enforcement ability has been widely upheld in the courts.

robonthemic have coach Dan Lewis of Friend University talked about this on previous podcasts? I'll throw it his way this Monday. In our very first episode in December 2019 (before I really got to know Dan), essentially he was brought in to help clean that part of the program's history and WIN). Ironically, that BYU/Lewis Natty was in Long Beach and it was the first NCAA Championship I worked. I specifically remember witnessing one of the highest scoring set EVER 44-42... being a newbie at the time I was just stoked to be there...

The strange thing is that as far as I know Hawaii didn't have to forfeit any other games and had no scholarship reductions or other penalties. Mike Wilton wasn't fired and Costas kept all his individual awards. (If you check the AVCA website he is still listed as player of the year). The only penalty was the vacated championship.

I was at that game in 2003. BYU had a number of foreign guys too (Moreno, Slabe, Paal, Pessoa, Batista) and there was always a lot of scrutiny/complaining about them back in the day.
When reading things about Lewis, it seems like Deuser got in more trouble for not cooperating with the investigation and allowing a player to travel who was already deemed ineligible. The guy got banned for a few years.
I saw a Facebook post by one of the players yesterday posing the question about getting their title back in wake of the Bush news. Deuser chimed in and said Lewis voluntarily vacated the volleyball title because they didn't want the NCAA digging around the athletic department and finding a myriad of problems with other sports (namely track and field).

I think the reason is because AVCA is separate from NCAA

It would be nice to have the title reinstated but it's definitely not a priority it seems with the UH program. Yes, the title was vacated. But we still know who won it all that year. So we will take that.
I will always remember that year because Hawaii lost to Pepperdine 3 straight times and handily. But they put it together when it mattered the most.
