Came up with this after watching "The Good Wife" last week. She separated from her husband for cheating on her, then slept with her boss the day after the separation.
This is black/white with me. Yes, it's adultery.

IMO, if both partners agree that the commitment is over, or if one partner clearly communicates to the other partner that the commitment is over, then it is over. The separation may involve this, or it may not.
So I believe that the answer to your question is, "it depends."

No, because it's fiction. To me, it would depend on what the purpose of the separation was. If they're headed to divorce, then no. Although adultery and cheating are not the same thing, right? The former is pretty cut and dried in religion.

Ruff, how are adultery and cheating different? I think it's just semantics. PotAto, potahto. Yes, adultery is a biblical term, but I believe it's also a legal term. Not talking religion.

With the understanding that we're talking about a prime-time soap opera...after going upstairs for video review, the referee picks up his flag - no penalty. At least she waited until the separation was official. She could have gone ahead and slept with the boss before separating, which would have been a clear 15 yards for unsportsmanlike conduct. By holding off, she avoided a clear-cut rules infraction.
But yeah, kinda slutty.

Soap Opera? Um - pretty sure this happens in real life, unlike Soap Opera drama. Forget the "Good Wife" example.
Is it okay to sleep with someone if you are legally separated.

I am going with yes/no on this one. Especially if seperation was due to one's cheating/adultery, then the non-cheating spouse can date as long as no sex is involved. She or he may just need that to get over the heartbreak. Dating yes - Sex no
